Costs of appealing

There are many costs involved in running an appeal in the Family Court. Legal fees if you choose to be legally represented and the cost of obtaining a transcript. In a recent case Knox and Knox involving an appeal from a six day trial, the cost of obtaining the transcript from Auscript was $12,000.

The appellant sought a copy of the transcript which was on the court record in the Federal Circuit Court, as the trial judge had ordered it to assist in delivering her judgement where the trial took place over a number of different sittings.

The trial judge did not grant the appellant’s request for a copy of the transcript citing policy of the legal committee of the Federal Circuit Court, to make any transcripts ordered by judges available to participants in the litigation to inspect but not copy.
